I get WHY he wants me to smash model..so i cant resell it. I am reasonable bloke and a partial refund not acceptable for mewith missing parts..(fallen off bits reparable yes) hence why return AT HIS COST and cheapest shipping was offered...AND ACCEPTED originally but only WHEN the replacement arrives...all without opening a case with eBay...He agreed to all this.

He then tried to play the dumb card and drag the process along so after no result and bullxxxt I has no choice but to open a case before too late.

IF he had opened his eyes and looked at the 'new' model he was selling he would have seen the blatent issues...there would ne no issues...however he is a ' male chicken '.

Now he request me to break up the model and send him pics so he THEN can apparently full refund me, he has been so upfront and honest up until now hasn't he...course his word means zero to me..Dont know how eBay would be on my side as its not how their policy rolls..Id rather inform them he refuses to pay the tracked shipping return costs and they refund me in full..he can still give me the low cost $ to return and i would do so....cant promise something nasty may or may not be inside the display case myself the way he treats his return buyers..customer service zero in my book.

Ian I did consider just that idea..VC Holden Commie HDT Brocky one...white resin but not a solid block cold cast one with alot of decal trims

Alright, perhaps I need to re-read your post. You said that "eBay sided with me to return and seller pays". So regardless of whether he is ignoring you, eBay has made their ruling and can shut him down for not obeying. With the separation of eBay and Paypal, I'm not sure how they enforce the refund. They used to be able to pull it from his PayPal account.

I understand that he was a jerk throughout the process and balked at the better offer you made to him earlier. Whether you smash the model or he accepts the charges to return it, you still don't have any guarantees that he will pay you. But you won the case and I feel you just ought to end this instead of continuing to argue. There's always the possibility that Pandavia doesn't refund your money, and there is nothing that you or eBay can do about that without paying lawyers. Probably the worst eBay will do is shut off his account. he can start a new one but he loses all his feedback. If he's as big a jerk as you say, it will be hard to maintain a high rating with fewer sales to average out.

So after waiting the required period waiting for the non existant 'return label' and payment from pandavia I escellated the case in the weekend.

placed a well deserved red face..in fact so has someone else right after mine.

Years ago I got a full refund, placed red face on someone else but was removed I guess due to me getting refunded..and no, was no swearing, threats etc to warrant it being pulled.

Some sellers seem to think that if you win a case you can't leave a negative and it's at times like this it's well deserved, regardless of the outcome.

Really happy to see this worked out for you Lars and he got what he deserved.

More importantly, its highlighted to the members here what a lowlife he is and hopefully stopped others suffering what I did.

My thoughts exactly Ian. Regardless of price and 'deals' or some such else, I will NOT do business on eBay with anyone that has less than a 99.9% feedback rating. It's not worth the hassle.
